These Terms and Conditions (“Terms”, “Terms and Conditions”) govern your use of Inovi Care’s services, including your consent to receive SMS text messages (the “Messages”) via a 10-digit long code (10DLC) from us. By providing your mobile phone number and agreeing to these Terms, you consent to receiving SMS messages as described below. Please read these Terms carefully.

1. Consent to Receive SMS Messages

By providing your mobile phone number and clicking the “I Agree” button, you consent to receive SMS text messages from Inovi Care, including marketing messages, transactional messages, account updates, customer support notifications, and other information related to the services we provide.

  • Message Content: You may receive marketing messages, reminders, updates, and other transactional communications relevant to our services.
  • Frequency of Messages: You may receive up to 10 messages per month. The frequency of messages will depend on your interactions with our services.
  • Carrier Charges: Standard message and data rates may apply based on your mobile carrier and service plan. Please check with your carrier for details.

2. Opt-In Process

You must explicitly opt in to receive SMS communications from us. By providing your phone number, you affirmatively consent to receiving SMS messages from Inovi Care.

  • Explicit Consent: Your consent is provided by entering your phone number during the registration process or subscribing to our services that offer SMS communication.

3. Opt-Out Process

You may opt out of receiving SMS messages from us at any time. To stop receiving SMS messages, you can reply “STOP” to any SMS message you receive from us.

  • Unsubscribe: If you reply “STOP,” you will be unsubscribed from receiving further messages from us.
  • Help: If you need assistance, reply “HELP” for information on how to manage your subscription.
  • Immediate Effect: Once you opt out, you will stop receiving SMS messages from us within a reasonable timeframe.

4. Message Delivery and Errors

While we strive to send messages promptly, message delivery is subject to delays or interruptions caused by factors outside of our control, including network issues, carrier restrictions, or technical difficulties. We are not responsible for delayed, undelivered, or misdirected messages.

5. Your Mobile Number

By providing your mobile phone number, you affirm that:

  • You are the rightful account holder for the number provided.
  • You have the legal right to provide us with this number and consent to receiving SMS messages from us.
  • You will notify us if your mobile number changes, so we can update your contact details accordingly.

6. Privacy and Data Protection

We take your privacy seriously and handle your personal information, including your mobile phone number, in accordance with our Privacy Policy. We will not sell or share your phone number with third parties for marketing purposes without your explicit consent.

  • Data Usage: The phone number you provide will only be used for SMS communications related to our services, including promotional, transactional, and service updates.
  • Data Retention: We will retain your phone number only for as long as needed to fulfill the purpose of SMS communications and comply with legal obligations.

7. Compliance with 10DLC Regulations

We comply with all applicable regulations for SMS messaging, including the 10DLC (10-digit long code) requirements, TCPA (Telephone Consumer Protection Act), and CTIA (Cellular Telecommunications Industry Association) guidelines. We are registered with The Campaign Registry as required for sending SMS messages via 10DLC numbers.

  • Campaign Registration: We have registered our SMS campaigns with The Campaign Registry as part of compliance with carrier and regulatory requirements for messaging.
  • No Spam: We do not engage in spamming activities, and we only send SMS messages that are requested by users or necessary for service purposes.

8. Limitation of Liability

While we strive to provide accurate and timely SMS communications, we do not guarantee that our SMS messages will always be delivered successfully. We are not responsible for any undelivered, delayed, or misdirected messages, or for any damages, losses, or costs that may arise from receiving or failing to receive such messages.

9. Changes to SMS Terms

We reserve the right to modify or update these SMS Terms at any time, including changes to the type of messages we send, the frequency, or any other aspect of our SMS communication practices. Any changes will be reflected on this page with an updated effective date.

  • Notice of Changes: We will notify you of any significant changes to these Terms by posting an updated version on our website or directly via SMS.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of California, and any disputes related to SMS communication will be resolved in accordance with those laws.

  • Dispute Resolution: Any disputes arising out of these Terms will be handled through mediation in California, and you consent to the exclusive jurisdiction of such proceedings.
